TERMS AND CONDITIONS

 

1. Tankedwheelspacers.co.uk (Tanked WS Ltd) is referred to in these Terms and Conditions as “Tanked WS”.
2. The customer is variously referred to in these Terms and Conditions as “customer”, “Consumer”, “you”. These terms are used interchangeably.
3. “Goods” in these Terms and Conditions refers to all products on Tanked WS’s website.
4. Prices quoted for Goods are inclusive of standard delivery charges, and VAT.
5.  Free delivery does not apply to non-UK mainland destinations.
6. Non-UK customers will no longer be charged UK VAT on the goods ordered from Tanked WS from 1 January 2021. However, they will be charged VAT at their local country rate together with customs duties when the goods enter the receiving country. These taxes are payable by the customer prior to the collection of the goods.
7. All goods remain the property of Tanked WS until paid for in full; this includes the payment of customs duties and local VAT in the case of non-UK customers.
8. Tanked WS reserves the right to change prices and specifications on products without prior notification.
9. Goods will not be despatched until payment has been received in full.
10. By placing an order with Tanked WS the customer accepts that they are fully aware of these Terms and Conditions.

1. All returns must be received in good condition at our distribution center. Goods will not be accepted if they are damaged, scratched, or not returned in the appropriate protective packaging. Returns must be properly wrapped and protected to give at least the same level of protection as when despatched by Tanked WS originally. Items inadequately protected/wrap will not be accepted for return, alternatively, a charge may be made to rectify any damage and any refund of the original purchase price will be reduced accordingly.
2. Your statutory rights under The Consumer Rights Act 2015 are not affected.

 

 WARRANTY CONDITIONS

1. The majority of the Goods sold by Tanked WS are supplied with the benefit of a warranty given by the Goods manufacturers. If the Goods become faulty during the warranty period for reasons unconnected with your acts, omissions, or misuse of the Goods then:
2. We will repair or replace the parts at our discretion.
3. You must afford Tanked WS a reasonable opportunity to investigate any warranty claim.
4. It is the customer's responsibility to remove and replace any faulty/warranty parts from their vehicle and to return them to Tanked WS’s distribution centre at their cost.
5. The above warranty is given by Tanked WS subject to it having no liability in respect of any defect arising from wear and tear, wilful damage, negligence, modification(s), tampering of the Goods, incorrect fitting of the Goods by you and/or a third party, abnormal working conditions, failure to follow our and/or the Goods’ manufacturers’ instructions (whether oral or in writing), misuse or alteration or repair of the Goods without our approval or for Goods fitted to any vehicle that is modified contrary to the vehicle manufacturer’s specifications and/or (default) factory settings.

WHEELS

1. Wheel nuts and Wheel Spacer nuts should be re-torqued after 25 miles and before 50 miles.

VEHICLE SAFETY EQUIPMENT AND SYSTEMS

1. Before fitting any Tanked WS product to a vehicle, the customer is responsible for ensuring that they will not affect the operation of airbags or any other vehicle safety equipment or vehicle safety system. Customers are also reminded to check the law regarding the fitting Wheel Spacers in their own country.

LIMIT OF LIABILITY

1. All warranties, conditions, and other terms implied by statute or common law (save for the conditions implied by the Consumer Rights Act 2015) are, to the fullest extent permitted by law, excluded from any contract between Tanked WS and the customer.
2. Tanked WS makes no representation or warranty for any implied warranty or condition as to the merchantability or fitness of Goods it supplies for a particular purpose.
3. Tanked WS makes no representation or warranty for the adequacy or appropriateness of the Goods for the purpose(s) for which the customer requires them.
4. Tanked WS disclaims any obligation or liability to you arising directly or indirectly from information taken from the Tanked WS website.
5. Tanked WS is not liable to you for any loss of profit, loss of business, loss of income or revenue, loss or corruption of or damage to data, waste of management or office time, or depletion of goodwill – however, caused and whether occurring directly or indirectly.
6. Tanked WS is not liable to you for any consequential, special, or punitive loss; neither is it liable to you for any damage, costs, or expenses.
7. Other than for any matter which it would be illegal for Tanked WS to exclude or attempt to exclude, Tanked WS’s liability to a customer under or connected with these terms will not exceed the price paid for the Goods, for any one event or series of connected events.

CONFIDENTIALITY

1. Tanked WS will not pass on, give, or publish any customer details of any nature which are held by us, unless legally obliged to do so.

RISK AND TITLE

1. Risk in the Goods will pass to the customer upon delivery of the Goods.
2. Title (ownership) in the Goods remains with Tanked WS and will not pass to the Customer until the amount due under the invoice for them or any other outstanding invoice from Tanked WS to the customer (including any interest and costs) has been paid in full.
3. Until such time as title (ownership) in the Goods passes to you (and provided that the Goods are still in existence and have not been resold), Tanked WS shall be entitled at any time to require you to deliver up the goods to Tanked WS and, where you fail to do so immediately on request, to enter your premises or any third party premises where the Goods are stored and repossess the Goods.
